Terms & Conditions

Taskit Application is owned by or on behalf of Salut Liltiknulujia LLC and its contact email address [support@taskit.om]. 


Please read the following general Terms and Conditions (hereinafter referred to as "T&C") carefully. It shall regulate Users' access and usage of “Taskit”, (hereinafter referred to as "Application" or "Taskit"). 


Taskit provides a platform to connect consumers (hereinafter referred to as “Clients”) with service providers (hereinafter referred to as “Service Providers”). Users are defined to include both Clients and Service Providers. 


Taskit facilitates the delivery of services offered by service providers, and any additional services introduced by Taskit contained within. A service is defined as any work carried out by the provider in favor of the consumer for a consideration or free of charge, (hereinafter referred to as “the Service”), as per the Consumer Protection Law. 


Taskit introduces Service Providers to Clients, directly or indirectly, in an individual, personalized and confidential manner. Taskit shall not be responsible for any losses, expenses, damage, delay, costs or compensation (whether direct, indirect or consequential) incurred by the Client due to the engagement of the service provider via third-party reference.


By downloading or otherwise accessing the Application you hereby agree to be bound by the following T&C and privacy policy. Additional features may be added to the Application, and those particular features may have its own terms and conditions, which will also apply in the context of using this Application in accordance with the T&C. The User acknowledges that s/he have read, understood, and hereby accept the T&C set forth herein and that:


1.    The User is a person with sufficient capacity to contract.
2.   The User assumes all the obligations set forth herein.
3.   The User is at least Eighteen (18) years old.
4.   The User will contact Taskit here, if the user does not understand or has any concerns regarding the T&C before agreeing to this T&C.

1.    GENERAL


1.    The T&C set below apply to:


a.    Any persons downloading and accessing Taskit;


b.    Any persons supplying in any way personal information (including name, age, height, weight, gender, medical history and email address) to Taskit through or in connection with the Application, whether by way of Taskit's contact form, by email or otherwise ("User"). 


c.    The User will need to register to the App, s/he will need to create an account, including a username & password. It is the User's responsibility to ensure that the information provided is accurate, not misleading and relates to the User.  The User cannot create an account or username & password using the names and information of another person or using words that are the trademarks or the property of another party (including Taskit), or vulgar, obscene or in any other way inappropriate. Taskit reserves the right with or without notice to suspend or terminate any account in breach of this condition.


d.    If for any reason the User suspects that his/her username and password has been disclosed to or obtained by another party, the User should contact Taskit immediately. Please note that Taskit will never contact users requesting them to confirm their username & password or other details.


2.    The User hereby acknowledges and agrees to be bound by the T&C.


a.    Taskit may suspend or discontinue providing their services to the User, if the User does not comply with T&C and policies. 


b.    By using the Application and any other services provided by Taskit through the Application, Taskit does not grant the User any Intellectual property rights in the Application, Services, or content provided by Taskit with the exception of the User's personal or information provided in the Application.

2.    ELIGIBILITY FOR REGISTRATION AND ACCOUNT SAFETY


The User represents and warrants that:


1.    The User access or use of the Application does not violate any applicable law or regulation.


2.    The User shall keep their contact information accurate and up to date.


3.    The User is responsible for protecting his/her account; which includes not disclosing his/her password, or granting anybody access to his/her account, jeopardizing the security of the account.


4.    The User shall not transfer his/her account (including any Page or application the User administers) to any person without prior written consent from Taskit.


5.    Taskit reserves the right to remove or reclaim a username or similar account identifier selected by the User, if it is inappropriate or violates Community Guidelines. 


6.    Taskit reserves the right to remove any negative comments posted by the User, that are contrary to the law or public security.

3.    SCOPE OF THE TERMS AND CONDITIONS


1.    The T&C shall apply to contracting of Services through the Application. The T&C do not replace, extend or modify contracts entered into between the User and the Service provider in relation to provided services.

4.    SERVICE REQUESTS AND PAYMENT


1.    The Client can make an online service request for Service Providers, describing the required task, time and location details at least One (1) hour in advance. The client shall verify the Service request details before submitting it through the Application.


2.    The Client shall receive status update notification via the Application as soon as a Service Provider has been assigned. If Taskit is unable to respond to the Client's service request for any reason whatsoever, the Client will be notified. 


3.    After a Service Provide has been assigned, the Client  shall have access to the entire profile of the Service Provider, where the Client will be able to communicate with the Service Provider.  


4.    A contract for services is formed between the Client and the assigned Service Provider, once the Client accepts the assigned Service Provider's offer. The contract may be entered to, whether the services request was posted on the Application or Taskit's website.  


5.    Once the Service provider is on-site, additional charges may apply, that include the prices of materials or any other services not specified in the request; issued and billed in a separate invoice to the Client, as per the agreement between the Service Provider and the Client. 


6.    The Service charges shall be the amount applicable at the time Client makes the request. 


7.    The Client may choose his/her preferred payment method for the Services online via the Application, and shall receive a receipt for it, saved in his/her account after payment confirmation. The Client may make the payments with Visa or MasterCard via Application, or cash to the Service Provider.


8.    The Company charges a fee from the total amount paid by Clients to Service Providers for each respective Service booked and performed by using the Platform (“Platform Utilization Fee”).


9.    The Platform Utilization Fee shall be deducted accordingly by the Company from the total amount received by a Service Provider from a Client for each Service.

 

 


5.    SERVICE SPECIFIC TERMS & CONDITIONS


•    Delivery:


The Client agrees to:


1.    Cooperate with the Service Provider in all matters relating to the Services.


2.    It to be transported do not contain items classified as hazardous materials, dangerous goods, prohibited items, or prohibited by international and domestic shipping regulations. These items include but are not limited to:


a.    Cash, bonds payable, gold and other precious metals


b.    Prohibited liquids


c.    Drugs and chemical narcotics


d.    Weapons, firearms, explosives and perishable items (food, fresh fruits and        vegetables).


e.    Trees and flowers


f.    Live animals


g.    Counterfeit and illegal goods


h.    Human remains.


3.    Permission to inspect the shipment in his/her presence before receiving it.


4.    Provide the Service Provider with all required documents and information.


5.    Inform the Service Provider of all health, safety and security requirements that apply to the customer's materials and that are required to be observed and taken care of by the Service Provider.

6.    RESCHEDULING OF REQUEST


1.    The Client may reschedule his/her request via Application itself at least One (1) hour before the selected service time.


2.    Reschedule requests made within the One (1) hour timeframe, are made by contacting Taskit here and may incur “Late Reschedule Charge” as following: 


Reschedule timeline: Less than One (1) hour before the scheduled time

 

Late Reschedule Charge: 3% of the total amount of service charges (Maximum Five (5) Omani Rials)

3.    If service request cancellation is accepted, whether free or charged, Taskit will refund any amount paid by the Client after deducting the Late Reschedule Charge (If applicable) within Seven (7) business days.


4.    If no amount has been paid by the Client, Late Reschedule Charges will be invoiced to the Client.

7.    CANCELLATION AND REFUNDS


1.    The Client may cancel any service requests within 12 hours since the payment has been made on the app, at no charge. Refund will be processed immediately, and the refund amount shall appear in the Client’s bank account within 1-5 business days.


2.    The Client may cancel any service requests for free at least Two (2) hours before the requested schedule time, by notifying Taskit here. 


3.    If the Client cancels his/her service request within Two (2) hours before the scheduled time, the following “Late Cancellation Charge” may apply:


Cancellation timeline: Up to Two (2) hours before the booking time


Late Cancellation Charge: 3% of the total amount of service fees (Maximum Five (5) Omani Rials)


4.    Late Cancellation charges include VAT, if applicable.


5.    If service request cancellation is accepted, whether free or charged, Taskit will refund any amount paid by the Client after deducting the Late Cancellation Charge (If applicable) within Seven (7) business days. 


6.    If no amount has been paid by the Client, Late Cancellation Charges will be invoiced to the Client. 


7.    If the User is entitled to a refund, it will only be made by the same means of payment as used by the Client.


8.    In case the Service Provider delivers the service at the scheduled time, but the Client is dissatisfied with the completed/delivered Service, the Client may not claim any refunds of the amount paid

8.    REFUND POLICY

​

It is important to Taskit that the Clients of our platform use it with confidence anytime a service is booked and therefore to ensure the quality of the service we guarantee the following under our Refund Policy.

​

1.    If the services are not completed according to the final scope and specifications indicated on the Taskit platform, we will work with you and the Service Provider to understand the problem and correct it to the best of our ability within a reasonable time following receipt of a claim from the Client. For purposes of this Policy, claim shall mean any complaint made in writing (including but not limited to by e-mail or fax) or filed electronically. No complete refund is allowed under this policy. The sole and exclusive remedies available to the Client in the event of incomplete or defective service are set out below and are at the sole discretion and option of Taskit:

​

a.    Taskit may provide the Client with a complimentary service on the next order made by the Client when using the Taskit platform; or


b.    Taskit may grant a discount coupon on the next order made by the Client, using the Taskit platform.


c.    Taskit may, considering the level of gravity of the defective or incomplete service, grant a pro-rata refund to the Client, it being expressly understood that any such refund will always be partial in nature and assessed by Taskit in its sole discretion.

2.    If Taskit's Service Provider does not show up or arrive on time and the service is not completed, we will work with you and the Service Provider to understand the problem and correct it to be best of our ability or provide a partial refund whenever applicable.

​

3.    Whenever applicable, Taskit shall process the refund in favor of the Client either to the Client account or as directed by the Client in his claim. The Client should expect 2-14 business days for the amount of the refund to his account or bank account. If no refund is received by the Client within the aforementioned period, the Client may report the same to Taskit

Refund Claim Conditions:

​

The Client can file a refund claim when all of the following conditions are satisfied:

​

1.    The service was booked by the Client on the Taskit Platform and complete details were entered correctly by the Client describing the nature of service, name, contact details, address etc. required for performance of the service by Taskit Service Provider.


2.    The service was not performed according to the scope of work detailed on Taskit platform.


3.    Service appointment was completed within the last 5 days.


4.    The Service was paid for by the Client.


5.    The Service was not completed due to a cause other that Client’s fault, omission or negligence.

Refund Claim Restrictions and Limitations:


1.    Taskit’s Refund Policy does not cover the following situations:


a.    Dissatisfaction with pricing or scheduling limitations.


b.    Claims caused by prior service or other service provider that does not belong to Taskit platform.


2.    Taskit only provides a platform where the customer and the service provider can be linked together, Taskit shall not be responsible or liable for any loss or damage (whether direct, indirect, special, consequential or incidental) of any sort whatsoever incurred as the result of any transaction.


3.    The maximum total liability of Taskit shall not exceed the total amount of service fees actually paid by the Client

9.    OBLIGATION OF THE CLIENTS


1.    The Client shall accept the Service Providers offer, according to his/her level of satisfaction of the Service Provider's qualification and suitability for the requested service. 


2.    The Client shall be responsible for obtaining work permits, other permits, or clearances for the Service Provider when necessary. It is the Client's responsibility to inspect the originals of any necessary documentation, when required. 


3.    The Client assumes full legal responsibility for tax compliances and public liability insurances of the Service Providers and compliance with all applicable legal requirements.


4.    The Client ensures that the Service Provider’s order has been completed before the Service Provider leaves the location of service delivery. 


5.    Without involving Taskit, the Client shall not agree to additional services not specifically mentioned, in the initial service request from the Service Provider. If this occurs, the Client will not receive a receipt from Taskit, and thus shall accept and assume all responsibilities from the outcome of the engagement and acknowledges the risk of the Users' Taskit account being suspended.

10.    EXCLUSION OF LIABILITY AND DISCLAIMER


1.    The Client acknowledges that the decision to employ a Service Provider is him/her sole responsibility, and that Taskit gives no warranty, representation or undertaking as to the history, character, age, experience, capability, suitability, honesty or immigration status of any Service Provider nor as to the completeness, truthfulness or accuracy of any information or statement or reference provided by the Service Provider. Taskit’s role is limited to connecting Clients with Service Providers and to facilitate the process of obtaining the requested service, and thus shall not be liable for any mistake, disagreement or the quality of provided services.


2.    The Client acknowledges the inherent risk in any services provided, and hereby waives all rights to any claim for damages against Taskit and any person involved in creating, producing or distributing Taskit service or information pertaining to the Service. Taskit does not accept any liability whatsoever for the misrepresentation, loss, damage, injury, death delay, claims or expense of any description arising out of an introduction made by Taskit.


3.    The person who created a content at Taskit, whether publicly posted or privately transmitted, is solely responsible for such content. Taskit may not monitor or control the content posted via the Service. Any use of, or reliance, or obtaining on any content or materials posted on the Platform the Service through the Service is at the Client's risk. 


4.    The Client understands that by using the Service, s/he may be exposed to content that might be offensive, harmful, inaccurate or otherwise inappropriate. Under no circumstances, Taskit will be liable in any way for any content, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of any content made available via the Service or broadcast elsewhere.


5.    The Client expressly understands and agrees that Taskit, its subsidiaries, affiliates, officers, agents, co-branders or other partners and employees shall not be liable to the client for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to damages for loss or profits, goodwill, use, data or other intangible losses, even if Taskit has been advised of the possibility of such damages, resulting from:


a.    the access or use of, or the inability to access or use the Application, all implied warranties, terms and conditions relating the Application;


b.    unauthorized access to or alteration of any of the Client's transmissions or data, including any User content;


c.    Any warranty, terms or conditions as to accuracy, operability, completeness, quality of the Application.


6.    Taskit hereby disclaims any liability and shall not incur any liability for any damages arising out of the services provided by the Service Provider and any damages to the home of the Client.

11.    DISPUTE RESOLUTION


1.    If a dispute arises between you and Taskit, our goal is to provide you with a neutral and cost-effective means of resolving the dispute quickly. Accordingly, you and Taskit hereby agree that we will resolve any claim or controversy at law and equity that arises out of the Terms of Use or the Platform in accordance with this Terms & Conditions or as we and you otherwise agree in writing. Before resorting to the filing of a formal lawsuit, we strongly encourage you to first contact us directly to seek a resolution via e-mail at support@taskit.om. The Terms of Use shall be governed in all respects by the laws of the Oman and any legal proceeding arising out of this Agreement will occur exclusively in the courts of competent jurisdiction in Muscat, Oman.

12.    WARRANTIES AND DISCLAIMERS


1.    Taskit is using a commercially reasonable level of skill and care and it hopes that the User would enjoy the use of the Application. Taskit does not warrant any commitment about the content within the services, the specific functions of the services, suitability and reliability of the services to the User's specific needs. Taskit attempts to ensure, but does not guarantee, the suitability of Service Providers. Suitability includes, but is not limited to, a Service Providers’ character, honesty, reliability or professional capacity. The Client shall, before engaging the Service Provider, accept the offer to the Client's level of satisfaction.


2.    Taskit will not be subject to any legal liability and will not be responsible for any failure or delay in the performance of any of the obligations and promises of the Service Provider.


3.    Taskit is not responsible for any possible damages that may be caused by the use of devices with defective Internet access or outdated versions of browsers or the Application, or as a result of the malfunctioning of the device, browser or Application.

13.    INDEMNITY


1.    The Client agrees, as long as it is not attributable to Taskit, to fully indemnify, defend and hold Taskit, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any and all claims or demands, liabilities, damages, losses, costs and expenses, including reasonable attorneys' fees, made by any third party due to or arising out of the Client's:


a.    Access and use of the Application or any Application contents thereof;
b.    Violation of the T&C;
c.    Violation of privacy policy;
d.    Violation of any rights of another;

 

 


14.    PRIVACY AND COPYRIGHT


1.    All copyright material contained on, in or available through Application are owned by Taskit or its proprietary holders, and all Users are required to abide by all copyright notices contained on the Application.


2.    Except to the extent otherwise specifically authorized by Taskit and/or the proprietary holders:


a.    The Users may not copy, modify, translate, publicise, reproduce, exploit, broadcast, transmit, distribute, perform, display or sell any of, or any portion of, any or all material, or create any derivative works thereof, and the Client may not use any of the material in connection with any commercial endeavours, whether in whole or in part;


b.    The Users may not alter the text, graphics, images, audio visual or any other materials.


3.    Any unauthorized reproduction, publication, further distribution or public exhibition of the material, in whole or in part, is strictly prohibited.


4.    Taskit's name, logo, domain name, and other names and logos of Taskit as may be created, produced or used from time to time, are trademarks or registered trademarks of Taskit and its affiliated companies. Without express written prior permission, the Client agrees not to display or use the trademarks in any manner and for any purpose whatsoever.

15.    CONFIDENTIALITY


1.    Each party undertakes to the other to treat all information, in any medium or format, whether marked as confidential or not) as confidential ('Confidential Information') which that party (the 'Recipient') receives from the other (the 'Disclosing Party'). 


2.    The Recipient may disclose Confidential Information of the Disclosing Party where required to do so by law or by any competent regulatory authority. In this case, the Recipient shall give the Disclosing Party prompt written advance notice of the disclosure (where lawful and reasonably practical to do so), so that the Disclosing Party has sufficient opportunity (where reasonably possible) to prevent or control the manner of disclosure by appropriate legal means.


3.    Taskit may disclose the Service Provider's personal information to third parties (including but not limited to):


a.    In the event that Taskit sells or buys any business or assets, Taskit may disclose the personal data to the prospective seller or buyer;


b.    If a third party acquires all or substantial amount of Taskit's assets, the personal data held by Taskit about its Service Providers will be transferred;


c.    If Taskit is under a duty to disclose or share a User's personal data in compliance with any legal obligation, or to enforce or apply these T&C and other agreements, or to protect the rights, property, or safety of Taskit, their Service Providers, its clients or others. This includes exchanging information with public organisations and supervisory authorities for the purposes of fraud protection and credit risk reduction.


4.    Taskit reserves the right to use comments and feedback Client’s give on Application as a way of promoting its services.

16.    ADVERTISEMENTS AND OTHER COMMERCIAL CONTENT


1.    Taskit provides advertising and other commercial or sponsored content, for the benefit of the user and the advertisers. By agreeing to these T&C, the client gives Taskit the permission to advertise and deliver other commercial or sponsored content.

17.    MODIFICATIONS TO THE APPLICATION, CONTENT AND TERMS AND CONDITIONS


1.    Taskit reserves the right at any time, and from time to time to modify or discontinue, temporarily or permanently, the Application or any part thereof, with or without notice to the User. The User agrees that Taskit shall not be liable to the User or any third party for any such modification, suspension or discontinuance of the Application or any part thereof. 


2.    The most current version of the T&C as posted on this page shall supersede all previous versions.


3.    It is the Client's responsibility to regularly check the availability of updated T&C. If the Client does not agree to any updates and revisions of the T&C, then the Client must immediately stop using the Application.


4.    The Client agrees that Taskit shall not be liable to anyone, for any modification, suspension or discontinuance of the Application, and/or amendments to the T&C. The Client's continued use of the Application after such modifications or amendments, shall constitute an acceptance and accordingly will be bound by the amended and updated T&C.

18.    OFF SITE LINKS


1.    In order to offer increased value to the Users, Taskit or a third party may provide links to external websites or resources, which the Client may access at his/her sole discretion.


2.    Taskit has no control over such sites and resources. As such, the Client acknowledges and agrees that Taskit is not responsible or liable for any content, advertising, products, services or other materials on or available from external sites. 


3.    Taskit shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.

19.    EMAIL POLICY


1.    Taskit will not respond unless required to do so by law to any email sent to us which contains threatening, abusive, malicious, pornographic, obscene, defamatory or otherwise illegal or inappropriate material. Taskit reserves the right to take such action as it is in Taskit's sole discretion deem fit in respect of such material.


2.    Taskit will not disclose any personal information under any circumstances of any staff, employee, contractor or worker of Taskit and/or Taskit's associates.


3.    Taskit will attempt to respond to all emails within two business days of receipt, but it is not committed to strictly respect this deadline. All emails will generally be stored for [60 Days] after which they may be deleted. Any email sent to the incorrect destination will be deleted immediately.

20.    PRIVACY POLICY

​

1.    The use of any personal information collected from the User is subject to our Privacy Policy, which is incorporated into this T&C by clicking here.

​

21.    NO THIRD-PARTY BENEFICIARIES


1.    The Client agrees that, except as otherwise expressly provided, in this T&C, there shall be no third-party beneficiaries to these T&C, and that the Client may not assign his/her profile or registration to any other persons.

22.    NOTICES


1.    If the Client provides Taskit with a nominated email address, Taskit may communicate with the Client by providing him/her with notices regarding updates, changes or additions to the Application or Services offered through or in connection with the Application, unless Taskit is expressly informed otherwise.

​

​

23.    AVAILABILITY AND TERRITORIAL SCOPE OF THE SERVICES


1.    Requested services will be available for the user only upon contracting, as per the general T&C.


2.    The territorial scope for the performance of the services is the Sultanate of Oman, even though the User may contract them anywhere in the world, subject to the availability of the Mobile Application.

24.    APPLICABLE LEGISLATION AND COMPETENT JURISDICTION


1.    The T&C shall be governed by and construed in accordance with Omani law. The User may bring any action s/he deems appropriate before the Omani courts corresponding to Taskit's domicile. When the User is not considered a consumer, the competent jurisdiction shall be the domicile of Taskit.


2.    Taskit guarantees that the Application complies with the laws & Regulation of Sultanate of Oman in all matters relating to the processing of personal data of Taskit.

25.    ENTIRE AGREEMENT


1.    The T&C constitute the entire agreement between the User and Taskit, and governs access and use of, or purchase through or in connection with the Application, superseding any prior agreements between the User and Taskit.


2.    The User  may be subject to additional terms and conditions that may apply when upon the use or purchase of certain other services of Taskit, affiliated services, third-party content or third-party software.

26.    WAIVER AND SEVERABILITY OF TERMS


1.    The failure of Taskit to exercise or enforce any right or provision of the T&C shall not constitute a waiver of such right or provision.


2.    If any provision of the T&C is found by a Court of competent jurisdiction to be invalid, the other T&C provisions remain in full force and effect.

27.    FEEDBACKS


1.    Taskit Application seeks to gain the satisfaction of its users by connecting them to the specialized and skillful Service Providers. Therefore, it is critical for Taskit to know Users' thoughts and feedbacks to assess their satisfaction with the Application. As such, please keep Taskit informed with reviews, with any service provided to the Client so that Taskit can assess and review the relation with the Service Provider whose services do not meet a Client's satisfaction.

28.    VIOLATIONS AND INFRINGEMENTS


1.    Any violations or infringement of the T&C should promptly be reported by the User by emailing Taskit at [support@taskit.om]

29.    CASH BACK, DISCOUNT, FEES & IN-APP CREDITS POLICY


1.    Taskit reserves the right to add, remove, change or edit any cash-backs, discounts, discount codes, promotions and in-App Credits at its sole discretion, and at any time it sees fit.


2.    The validity of discount codes, discounts, credit and cash-back is limited to 36 months as an absolute maximum. Taskit reserves the right, at its sole discretion to disable, cancel or invalidate the credits, discounts, discount codes, cash-back and promotional codes at any time it sees fit.


3.    Discounts, Discount Codes, In-App Credits, Cash-Back are not transferable to any other party without the approval of Taskit’s management.


4.    In-App Credits can under no circumstances be transferred outside the application or website to another platform or account.
